Terms & Conditions — The Asher Method

These Terms & Conditions ("Terms") govern your access to and use of the website, content, and membership services (the "Service") provided by The Asher Method("we", "us", "our"). By creating an account, joining the waitlist, or purchasing a membership, you agree to these Terms.

1. Who you are contracting with

You are contracting with Ashley Godwin, a sole proprietor trading as The Asher Method, located at 2032 Cold Rocks Way, Lexington, SC 29073, United States ("we", "us", "our"). Payments, invoicing, and tax are handled by our reseller — see Section 6 below.

2. Eligibility and account

You must be at least 18 years old (or the age of majority where you live) to purchase a membership. If you use the Service on behalf of an organization, you confirm you have the authority to bind that organization. You are responsible for keeping your login credentials confidential and for all activity under your account. Please provide accurate information and keep it up to date.

3. The Service

The Service provides on-demand pilates fusion workouts, guided meditations, recipes, and access to a private member community. Features available to you depend on the membership tier you purchase (Essential, All Access, or VIP). We may add, change, or remove features from time to time.

The Service is intended for general wellness and educational purposes only. It is not medical advice. Consult a qualified healthcare professional before starting any exercise or nutrition program, especially if you are pregnant, have an injury, or have a medical condition. You participate at your own risk.

4. Acceptable use

You agree not to:

use the Service unlawfully or for fraud, spam, or harassment;
infringe anyone's intellectual property, privacy, or other rights;
interfere with the security or integrity of the Service (including probing, scraping, uploading malware, or bypassing rate limits or access controls);
share your account, resell access, or redistribute our content;
reverse engineer or attempt to extract source code from the Service.

In the community chat and any user-visible areas, be respectful. We may remove content or restrict accounts that violate these rules or the platform's community guidelines.

5. Intellectual property

The Service, including all workouts, meditations, recipes, videos, audio, text, imagery, branding, and software, is owned by The Asher Method or its licensors and is protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your personal, non-commercial use while your membership is active.

If you post content in the community (messages, comments), you keep ownership of it and grant us a worldwide, non-exclusive license to host, store, display, and process that content solely to operate and improve the Service.

6. Payment, billing, and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and Refund Policy.

Memberships are billed monthly in advance and renew automatically at the then-current price until you cancel. You can cancel at any time through your account's billing portal; your access continues until the end of the paid period. Upgrades take effect immediately with a pro-rated charge; downgrades take effect at the end of the current billing cycle. See our Refund Policy for refund terms.

7. Availability and warranties

We work hard to keep the Service available, but we do not guarantee it will be uninterrupted, error-free, or secure at all times. The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

8. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the amount you paid us in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (such as for fraud, death, or personal injury caused by our negligence).

You agree to indemnify us against any third-party claim arising from your content, your misuse of the Service, or your breach of these Terms.

9. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly violate our acceptable use rules. You may cancel your membership at any time from the billing portal. When your membership ends, your access to paid content stops; we may retain records as described in our Privacy Notice.

10. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify active members by email or through the Service. Continued use after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict-of-laws rules. Disputes will be resolved in the competent state or federal courts located in South Carolina, except where mandatory local consumer law grants you the right to bring a claim in your home jurisdiction.
